Which states have AI ethics rules for lawyers?

As of October 2026, this navigator lists 38 jurisdictions (including D.C.) with a rule, statute, court rule, formal opinion or published guidance on lawyers’ use of generative AI. Colorado amended its Rules of Professional Conduct in January 2026, New York’s courts adopted Part 161 effective June 1, 2026, and California enacted SB 574, effective January 1, 2027.

If my state has no guidance, can I use AI freely?

No. Your existing rules of professional conduct still apply, including competence, confidentiality, communication, candor, supervision and reasonable fees. ABA Formal Opinion 512 explains how those duties apply to generative AI, and individual judges may have standing orders.

How current is this?

It was compiled in October 2026 from issuing bodies and public trackers. Bars and courts publish new guidance often. Always confirm with the issuing body and check the standing orders of the judges you appear before.
